December 7, 2010                                     Special Session                                            7:00 p.m.

 

Chairman Randy Brown called the Special Session of the Board of Sugar Grove Area Sewage Authority to order at 7:03 p.m. at the Sugar Grove Township Building, Sugar Grove, Pennsylvania.  Brown led all in the Pledge of Allegiance.

 

Board Members Present:  Randy Brown, Carl Black, George Sanders, and Dave Slater

 

Absent:  Randy Tack

 

Others Present:  Andrea Stapleford from Stapleford & Byham, LLC

 

            Visitors Present: Kevin & Jennifer Nicklas, Greg Klomp, Dutch Strand, Kevin McIntyre, Lary Oaks, Janet Oaks, Melvin Yoder, Sam Byler, Joe Yoder, Joe Byler, Aden Yoder, Mike Zurkan            

           

Public Comment Period: 

            The reason for the special meeting was to discuss a possible alternative for the amish community to connect to the sewer system.  Greg Klomp stated everything should be exactly the same way for everyone as far as connecting to the sewer system.  He also stated that they use all of our modern conviences.  Andrea Stapleford stated the sewage authority was created as a manadate by the state.  There was a lengthy discussion that followed.  The board is obligated to enforce the sewage facalities act.  When the members present from the amish community were asked for their input, their response was no comment.  Andrea Stapleford stated that we had our answer.  Randy Brown stated that we had negotiated an agreement with Mr. Joe Yoder, of Catlin Hill, and they have now broken this agreement.  Mike Zurkan  stated it is a state law and they should all comply.  Larry Oaks stated a lot of sewage comes out to the ditches.  The next steps to possibly take will be ligitation, criminal complaints, injuctions, and removal from homes and padlocked, jail time, and fines.  The authority has the power to connect properties to the sewage system, ie. – install grinder pumps, electric, etc.   Carl Black closed the public comment period at 7:56 p.m..

 

Business:

            Andrea Stapelford stated that some issue has to be taken with Mr. Joe Yoder.  Dave Slater made a motion to proceed with litigation in the Joseph Yoder matter, seconded by Carl Black.  The motion carried.   

 

            Randy Brown made a motion to adjourn the meeting, seconded by Carl Black.  The motion carried and the meeting was adjourned at 7:57 p.m.
